Please read these Terms of Service ("Terms," "Agreement") carefully before using the website atolaswim.com (the "Site") or purchasing any products offered through it (the "Products"). These Terms constitute a legally binding agreement between you ("you," "your," "the Customer") and CALEA Limited, a company incorporated in Hong Kong, operating the Atola Swim brand ("Atola Swim," "we," "us," "our").

By accessing the Site, creating an account, or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. Eligibility

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to place an order on the Site. By using the Site, you represent and warrant that you meet this requirement, or that you are using the Site under the supervision of a parent or legal guardian.

2. About Atola Swim

Atola Swim is operated by CALEA Limited. All references to "Atola Swim" refer to the brand and its products as marketed and sold via this Site, operated under the authority of CALEA Limited.

3. Products and Availability

• All Products displayed on the Site are subject to availability. We reserve the right to discontinue any Product at any time.
• We make every effort to display colors, materials, and details of our Products as accurately as possible. However, we cannot guarantee that your device's display will accurately reflect the actual color or finish of the Product.
• We reserve the right to limit the quantities of any Products that we offer, and to refuse or cancel any order for any reason, including suspected fraud, errors in pricing or product information, or violation of these Terms.

4. Pricing and Payment

• All prices are listed in USD and are subject to change without notice.
• Prices do not include applicable duties, taxes, or shipping fees unless explicitly stated at checkout.
• Payment is processed securely through Shopify's payment infrastructure and third-party payment processors (e.g., Shopify Payments, PayPal, Klarna). We do not store your full payment card details.
• By providing payment information, you represent that you are authorized to use the selected payment method.
• We reserve the right to refuse or cancel any order in the event of a pricing error, suspected fraudulent activity, or unavailability of stock, in which case you will be notified and any payment already made will be refunded.

5. Order Confirmation

Receipt of an order confirmation does not constitute acceptance of your order or a guarantee that the Product is available. Atola Swim reserves the right to accept or decline your order at any time after receipt of an order confirmation.

6. Shipping and Delivery

• Estimated shipping and delivery times are provided at checkout and on our Shipping Policy page, but are not guaranteed.
• Risk of loss and title for Products pass to you upon delivery to the shipping carrier.
• Atola Swim is not responsible for delays caused by customs, carriers, or events outside of our reasonable control.
• International orders may be subject to import duties and taxes, which are the responsibility of the customer.

7. Returns, Exchanges, and Refunds

Please refer to our dedicated Return & Refund Policy, available here, which forms part of these Terms. In general:

• Eligible items may be returned within 30 days of delivery, provided they are unworn, unwashed, and in original condition with tags attached.
• For hygiene reasons, certain items (e.g., swimwear bottoms in contact with skin) may not be eligible for return once the hygiene liner has been removed.
• Refunds are issued to the original payment method within 7 business days of receiving and inspecting the returned item.
• Sale items, gift cards, and items marked "Final Sale" are not eligible for return or exchange unless required by applicable law.

8. Account Registration

If you create an account on the Site, you are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

9. Intellectual Property

All content on the Site — including but not limited to the Atola Swim name, logo, product designs, photographs, graphics, text, and software — is the property of CALEA Limited or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on the Site without our prior written consent.

10. Prohibited Conduct

When using the Site, you agree not to:

• Use the Site for any unlawful purpose or in violation of these Terms;
• Attempt to gain unauthorized access to the Site, its servers, or any connected systems;
• Interfere with or disrupt the operation of the Site;
• Use any automated system (bots, scrapers) to access the Site without our express permission;
• Submit false or misleading information, including fraudulent payment information.

We reserve the right to suspend or terminate your access to the Site at our sole discretion if we believe you have violated these Terms.

11. Third-Party Services

The Site is built on the Shopify platform and may integrate with third-party services (payment processors, shipping carriers, marketing tools, review platforms). Your use of such third-party services may be subject to their own terms and privacy policies, which we encourage you to review.

12. Disclaimer of Warranties

The Site and all Products are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, CALEA Limited disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure.

13. Limitation of Liability

To the fullest extent permitted by applicable law, CALEA Limited, its officers, directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or related to your use of the Site or Products. Our total liability for any claim arising from these Terms or your purchase shall not exceed the amount you paid for the Product(s) giving rise to the claim.

Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law (including, where applicable, liability for death or personal injury caused by negligence, or fraud).

14. Indemnification

You agree to indemnify and hold harmless CALEA Limited and its officers, directors, employees, and affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of your use of the Site, your violation of these Terms, or your violation of any rights of a third party.

15. Consumer Rights

Nothing in these Terms is intended to limit any statutory rights you may have as a consumer under the mandatory laws of your country of residence, including rights relating to product conformity, cancellation, and returns, to the extent such laws apply to your purchase.

16. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Hong Kong, without regard to its conflict of law principles, except where mandatory consumer protection laws of your country of residence provide otherwise. Any dispute arising out of or relating to these Terms shall first be attempted to be resolved informally by contacting us at support@atoleaswim.com. If unresolved, disputes shall be subject to the exclusive jurisdiction of the courts of Hong Kong, unless applicable law grants you the right to bring proceedings in your own country of residence.

We reserve the right to update or modify these Terms at any time. Changes will be posted on this page with an updated "Last Updated" date. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.

18. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
